A lawsuit claiming negligence against Academy Sports + Outdoors for selling guns to Sutherland Springs gunman Devin Kelley can proceed to trial.

District Judge Karen Pozza denied a motion today by Academy to dismiss the case.

Sutherland Springs families had sued Academy, saying it should not have sold a Ruger-556 and 30-round magazines to Kelley, who killed 26 worshippers and injured 20 others at the First Baptist Church on Nov. 5, 2017.

Kelley bought the guns at a store in San Antonio about 18 months before the shooting.
